Consequences of illegal work

Legal-Advice-Migrants-WarsawAccording to the Polish law when employing migrants illegally, both employer and employee will suffer the consequences.

FOREIGNER:

  • if a foreigner works without a work permit when such is required, he could be punished with a fine from 1000 to 5000 PLN;
  • if a foreigner works in another position than the one indicated in the work permit, he could be punished with a fine from 1000 to 5000 PLN;
  • if a foreigner works on terms other than those specified in the work permit, he could be punished with a fine between  3000 and 5000 PLN.

EMPLOYER:

  • if a foreigner works without a work permit when such is required, employer shall be punished with a fine from 3 000 to 5 000 PLN;
  • when a foreigner works in another position than the one indicated in the work permit, employer shall be punished with a fine between 3 000 and 5000 PLN;
  • when a foreigner works on terms other than those specified in the work permit, employer shall be punished with a fine from 3000 zł to 5000 PLN.
